A near unanimous political will brought the UAPA into current form. It has stood the test of judicial scrutiny so far.
I will not go into into the individual case of Dr Anand Teltumbde as it is pending for court review. I will limit myself only to the UAPA and it's relevance.
If UAPA is repealed, how would the state deal with cross border terrorism the manifestation of which we saw during the 26/11 attack or the Pathankot attack?
Moreover please explain how UAPA limits the scope of free speech?
The right to free speech is sacrosanct but it's not absolute. It comes with great responsibility as has been underlined by the Supreme Court many times!
The author has also termed the BJP government as vicious but forgets that it's the majority of this country that has given mandate to the BJP to rule at the centre - twice!
The Elgar Parishad case was probed by two agencies of the country - Maharashtra police and NIA and both of come to similar conclusions about alleged culpability of certain individuals and matter is now pending before court and if these individuals are innocent, the court will release them but there is process under which justice is dispensed in the country and it has to be respected.
As regards bail of individuals during pandemic, I strongly believe all those prisoner who are not a flight-risk should be released on bail with strict conditions to ease overcrowding of jails.
I know my views might be unpopular with so-called liberals but I believe that the courts of the country are still run on the basis of IPC and CrPC and other special laws.
And last but not the least bad execution doesn't make a law bad!
