The Supreme Court of India heard the batch of pleas pending in high courts of Delhi and Kerala seeking recognition of same-sex marriage in India.
The top court transferred to itself the batch of petitions seeking recognition of same-sex marriage in India under the Special Marriage Act (SMA).
The matter was listed before a bench of judges comprising Chief Justice of India DY Chandrachud, Justice PS Narasimha and JB Pardiwala.
The bench asked the Centre to file its joint reply to all the petitions on the issue by February 15 and directed that all the petitions will be listed in March. It also provided liberty to petitioners to appear on virtual platform and advance their submissions in case they are unable to engage a counsel or travel to Delhi.
It asked the counsels from the Centre and petitioners to file a written note on the issue, laws and precedents, if any, and share it among themselves and the court.
The bench also appointed Advocate Arundhati Katju on behalf of petitioners and Advocate Kanu Agarwal on behalf of Union of India as nodal counsels and requested them to prepare compilation of precedents, documents, and legislations on the matter.
Before the petitions were heard seeking legal recognition for same-sex marriages, United Hindu Front protested outside the top court. Organisation say being gay is against Indian culture and Supreme court cannot hear the case.
