High Court Orders Attachment of Land Acquisition Collector’s Office in Gurugram for Non-Compliance of Land Compensation Orders
Chandigarh, November 29, 2024: The Punjab and Haryana High Court today ordered the attachment and sealing of the offices of the Land Acquisition Collector (LAC), Gurugram, and the Estate Officers I & II of HSVP, Gurugram, for deliberate non-compliance with court directions to compensate petitioners for land that was utilized without acquisition.
The petitioners approached the court after their 4 Kanal 15 Marla land in Narsingpur Kasan, Manesar, was used for sector roads development without acquisition said Advocate Gaurav Aggarwal .Despite a court order dated April 15, 2024, directing authorities to initiate acquisition proceedings and disburse fair compensation under the Right to Fair Compensation and Transparency in Land Acquisition Act, 2013, compliance was delayed.
The court noted that despite provisional assessment of compensation at ₹6.41 crore based on collector rates, the authorities had neither initiated formal acquisition nor released compensation, even after 13 years of possession. Highlighting the violation of Article 300-A of the Constitution, the court termed the respondents’ actions as “willful and deliberate.”
The Deputy Commissioner and Commissioner of Police, Gurugram, have been directed to enforce the order immediately and submit a report. The matter is listed for further hearing on December 2, 2024.
